Dental Protection provides additional protection for practice principal members

There has been growing concern about vicarious liability and non-delegable duty of care claims in the UK dental profession as a result of activity by claimant solicitors in this area. 

The recent court decision in Breakingbury v Croad has resulted in practice owners feeling vulnerable, even in cases where they have had no involvement in the treatment provided.

As a member first organisation, Dental Protection wants to ensure the protection it offers to existing and future members responds to a changing claims environment.

Extended member benefits

From 1 June 2021, we have extended member benefits for current and new practice principal members to include additional protection against vicarious liability and/or non-delegable duty of care claims relating to treatment provided by self-employed, contracted dental practitioners.

Dental practice principal members can now request assistance for vicarious liability and/or non-delegable duty of care claims arising during both their future and past membership, not just in relation to employees, but also for self-employed dental practitioners working at the practice.

Responding to members’ needs

For dental practice principal members who have three or fewer unincorporated practices, this enhancement has been applied automatically at no additional cost.
